By installing the Xplofy Application, submitting your credentials on our web portals, subscribing to research digests, or interacting with our APIs, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and our Privacy Policy.

• You affirm that you are at least 18 years of age (the age of majority under Indian law), or at least 13 years of age accessing the service with the explicit supervision and consent of a parent or legal guardian.
• Access, registration, or interaction by individuals under 13 years of age is strictly prohibited without verifiable parental authority.

02 // AI Synthesis Disclaimers & Editorial Neutrality

Xplofy utilizes automated natural language understanding, neural vector clustering, and machine learning models (the proprietary Xp37 Cognitive Engine) to ingest, neutralize editorial bias, vectorize, synthesize, and contextualize public news reporting:

• Primary Source Attribution: Xplofy attributes core factual reportage to verified primary publications, government wires, and accredited broadcasters. Xplofy acts as an intelligence synthesizer and does not claim primary copyright ownership over external third-party factual events.
• Educational & Informational Scope: All 60-word smart briefs, 5W context dossiers, and studio-grade neural audio casts are generated strictly for general informational, educational, and cognitive assistance purposes. They do not constitute legal, medical, financial, investment, or statutory advisory services.
• Editorial Independence & Algorithmic Neutrality: While the Xp37 engine eliminates sensational adjectives and highlights diverse perspectives with 99.4% lateral accuracy, readers are encouraged to consult linked primary accredited publications for formal source verification.

03 // Brevo Subscriptions & Communication Consent

By entering your name and email on our web portal (e.g. for Beta Pre-Registration or Newsletter subscriptions), you consent to receiving transactional token emails, beta onboarding dispatches, and research updates via our Brevo delivery infrastructure. You maintain the right to unsubscribe instantly at any time via the one-click link included in every correspondence or by contacting care@xplofy.com.

04 // Acceptable Use & Platform Security Safeguards

Users agree strictly not to engage in any of the following unauthorized activities:

• Deploying automated scrapers, bots, crawlers, or extraction scripts against the Xp37 API, mobile gateways, or Cloudflare edge servers without express written license.
• Attempting to reverse-engineer, decompile, disassemble, or extract source code from the Xplofy Mobile Application binary or internal neural model weights.
• Transmitting malicious payloads, SQL injections, or attempting denial-of-service (DDoS) disruption against platform infrastructure.
• Violating any provision of the Information Technology Act, 2000 or the Indian Penal Code / Bharatiya Nyaya Sanhita (BNS).

05 // Intellectual Property & XP-Pass Governance

All intellectual property rights in the Xplofy platform, the Xp37 Cognitive Engine, software binaries, brand marks, typography, audio cast compositions, and interface designs are the sole and exclusive property of KALBHYX Private Limited.

06 // Limitation of Liability

To the maximum extent permitted by applicable Indian law, KALBHYX Private Limited, its directors, employees, and licensors shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of, or inability to use, the platform or reliance on automated AI news summaries.

07 // Governing Law, Dispute Resolution & Exclusive Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the substantive laws of the Republic of India, without giving effect to any conflict of law principles.

Subject to applicable dispute arbitration frameworks, the competent civil courts located in Bhubaneswar, Odisha, India shall possess exclusive territorial and subject-matter jurisdiction to adjudicate any claims or disputes arising under these Terms.
